ACUS’s most notable activity is making formal recommendations to the President, federal agencies, Congress, and the Judicial Conference of the United States. A project initiated to formulate such a recommendation most often begins with a research study conducted by an academic consultant(s). The study results in a report that is usually placed before a committee of ACUS members. The committee drafts a proposed recommendation, if it deems one appropriate, for the Assembly’s consideration. With the Council’s approval, the Chairman may place the proposal before the Assembly for debate at a plenary session. The Assembly may adopt it, with or without amendments, as a formal ACUS recommendation. Adopted recommendations are published in the Federal Register and on the ACUS website.
