International Regulatory Cooperation

Recommendation 2011-6 – International Regulatory Cooperation addresses how U.S. regulators can interact with foreign authorities to accomplish their domestic regulatory missions and eliminate unnecessary non-tariff barriers to trade. The recommendation includes proposals for enhanced cooperation and information gathering, more efficient deployment of limited resources, and better information exchanges.

In June 1991, the Administrative Conference issued Recommendation 91-1, “Federal Agency Cooperation with Foreign Government Regulators,” finding that “[i]f American administrative agencies could ever afford to engage in regulatory activities without regard to the policies and practices of administrative agencies abroad, the character and pace of world developments suggest that that era has come to a close,” and recommending...

Implementation

The key features of this recommendation were incorporated into Executive Order 13,609. Executive Order 13,609 directed the Regulatory Working Group to serve as a forum to discuss and coordinate government practices with respect to international regulatory cooperation and directs agencies to coordinate with key trading partners to eliminate unnecessary regulatory divergences.
