EOIR has concerns that as currently drafted the ex parte communication recommendation appears to prohibit any form of ex parte communication.  However, there are often communications between government agencies that do not impact the substantive adjudication but may involve administrative processes that improve case processing efficiencies for all parties.  To require notice to the parties before action may occur is not necessarily an efficient requirement for all parties and may add significant delays to proceedings.
