ACUS has released its newest Information Interchange Bulletin: Early Input on Regulatory Alternatives.
The Bulletin provides a high-level overview of why agencies solicit input on alternative regulatory approaches early in the rulemaking process and how they can benefit from doing so. Based on Recommendation 2021-3, which ACUS recently adopted at its June 2021 plenary session, the Bulletin provides an overview of best practices agencies should take into account when they seek early input on regulatory alternatives.
ACUS’s Office of the Chairman releases new Information Interchange Bulletins on an ongoing basis. Recent Bulletins have covered retrospective review, notice-and-comment rulemaking, and the basics of the Equal Access to Justice Act and the National Environmental Policy Act.
