International Regulatory Cooperation

At its Plenary Session on December 8-9, 2011, the Administrative Conference of the United States adopted Recommendation 2011-6, regarding regulatory cooperation amongst United States agencies and foreign authorities.  This recommendation is the result of the public, consensus-driven work of the Committee on Regulation of the Assembly of the Conference.  The Conference previously posted drafts of the report and recommendation and invited public comment.

Project Background

In 1991, ACUS issued Recommendation 91-1, which provided guidance for all U.S. regulatory agencies on working with their international counterparts. In April 2011, ACUS co-sponsored a workshop with the U.S. Chamber of Commerce to explore how U.S. regulatory agencies interact with their foreign counterparts and with U.S. government agencies responsible for trade promotion. At this workshop, officials from government and industry identified a variety of challenges in international regulatory cooperation, from the perspective of regulatory effectiveness and facilitation of commerce, and suggested areas in which 91-1 could be updated to provide more specific guidance.

The ACUS research project on international regulatory cooperation examined how Recommendation 91-1 might be updated to incorporate developments in United States government structure, trade agreements, and technology since the recommendation was adopted 20 years ago.

Details of the Committee Process

The Committee on Regulation held two meetings in the fall of 2011 to discuss the project and decide upon a draft recommendation.  Please see the links below for the documents considered by the Committee on Regulation during those meetings.
