Equal Access to Justice Act: Model Rules for Implementation

Under the Equal Access to Justice Act, agencies are required to establish by rule uniform procedures for the submission and consideration of applications for awards of fees and other expenses, after consultation with the Chairman of the Administrative Conference (5 U.S.C. § 504(c)(1)).  In partial fulfillment of its consultation responsibilities under the Act, the Conference issued its “Final Revised Model Rules” in 1986 (51 FR 16665, May 6, 1986).
